Designing Fair Private Tenders in Ghana

Private procurement has flexibility, but flexibility is not the absence of discipline. A clear, proportionate and consistently administered process attracts stronger suppliers and reduces disputes.

The strategic question

Design backwards from the business outcome and award decision. Publish only requirements the buyer can explain, evaluate and administer fairly.

Write an outcome-led scope

Describe context, deliverables, interfaces, constraints and acceptance. Separate mandatory requirements from areas where suppliers may propose alternatives.

Keep qualification proportionate

Ask for evidence needed to control real delivery risk. Excessive turnover, experience or document demands can reduce competition without improving the outcome.

Create an executable timetable

Allow time for supplier questions, addenda, response preparation, evaluation and approvals. Avoid dates that force either suppliers or evaluators into superficial work.

Protect confidentiality and consistency

Control access to bids, declare conflicts, issue material information consistently and document evaluation. Supplier trust is a commercial asset.

Practical operating checklist

  • Define the business outcome.
  • Use proportionate requirements.
  • Publish the evaluation method.
  • Provide a formal question route.
  • Secure and document the decision.

The BidScope perspective

BidScope-managed tenders can provide the workflow, but the buyer remains responsible for lawful authority, accurate requirements and the award decision.

Questions decision-makers should ask

What evidence would change our decision?

Name the missing fact, document or commercial assumption before committing resources. A disciplined team separates what it knows from what it merely hopes is true.

Who owns the next action?

Every qualified opportunity needs one accountable owner, a dated next action and an internal deadline earlier than the buyer's deadline. Without those controls, an opportunity is only a bookmark.
